SELECT TRANSFERS TERMS OF SERVICE
1. Company Information 1.1. Company: Select Transfers is a brand operated by Qivik SAS, a private company duly registered in France under company registration number 894235241 with its registered office located at [Company Address] ("Qivik SAS"). Qivik SAS is registered with the Ministry of Transportation under reference number EVTC069230137. 1.2. Acceptance of Terms: By accessing or using the Select Transfers website, mobile application, or booking services ("Services"), you (the "Customer") agree to be bound by these Terms of Service ("Terms"). These Terms govern your access to and use of the Services and constitute a binding agreement between you and Qivik SAS.
2. Reservations and Bookings 2.1. Booking Methods: Customers may book transfers through the following methods : - Online booking on the Select Transfers website. - Telephone booking by calling +33 6 56 69 56 56. - Email booking by sending an email to hello@selecttransfers.com.
2.2. Booking Confirmation: Upon successful booking, the Customer will receive a "private transfer confirmation" email containing details such as departure date, time, pickup and drop-off addresses, passenger information, and the contact details of the driver.
2.3. Deposit and Payment: To secure a booking, a 20% deposit of the total transfer fee is required. The deposit can be paid by credit card or wire transfer. The remaining balance is due to the driver at the time of service. By making the deposit, the Customer acknowledges and accepts these Terms.
3. Insurance 3.1. Professional Liability: Qivik SAS maintains professional responsibility liability insurance with HISCOX under contract number HSXIN320028240A to cover potential customer claims. 3.2. Commercial Driving Insurance: Qivik SAS maintains professional commercial driving insurance with ALLIANZ under contract number 2105788 to ensure proper coverage for passenger safety.
4. Pricing and Inclusions 4.1. Fee Structure: The transfer fee includes the following: i) 30 minutes of complimentary wait time after flight landing (based on flight tracker data) or appointment time (non-airport transfers). ii) A complimentary bottle of water. iii) French VAT (10%). iv) Meet and greet service at the airport (airport transfers only). v) Luggage assistance. vi) Tolls on all French private and public roads and motorways.
4.2. Fee Exclusions: The transfer fee does not include the following: i) Tolls on international tunnels (Mont Blanc, Fréjus, Eurotunnel). ii) Wait time exceeding 30 minutes (charged at €60 per hour). iii) Credit card processing fees with payment terminal (inform dispatch beforehand if paying by credit card).
5. Cancellations and No-Shows 5.1. Cancellation Policy: Cancellations made more than 24 hours before the scheduled transfer time will incur a 20% cancellation fee. Cancellations made within 24 hours of the scheduled transfer time are non-refundable. 5.2. No-Show Policy: If the Customer fails to contact the driver within one hour after the scheduled arrival time of the flight or the appointed departure time, the transfer will be considered a no-show, and no refunds will be issued.
6. Driver Information Dispatch will provide the Customer with the contact details of the assigned driver 24 hours before the scheduled transfer time.
7. Disputes and Complaints - 7.1. Complaint Process: All complaints regarding the Services should be addressed to hello@selecttransfers.com. 7.2. Formal Complaints: If the complaint remains unresolved, the Customer may submit a formal complaint in writing to Qivik SAS, 4 Av Joannes Hubert, 69160 Tassin, France. 7.3. Governing Law: Any disputes arising from or related to these Terms will be governed by and construed in accordance with the laws of France, with the exclusive venue for any such dispute being the courts of Lyon, France.
8. Limitations of Liability 8.1. Maximum Liability: Qivik SAS's liability to the Customer under these Terms shall be strictly limited to the amount of the transfer fee paid by the Customer. In no event shall Qivik SAS be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with the Services.
9. Children as Passengers 9.1. Parental Responsibility: Children under the age of 18 cannot be transported without a parent or legal guardian accompanying them. 9.2. Child Safety: The parent or legal guardian accompanying the child is solely responsible for the child's safety during the entire trip, including breaks. This includes ensuring the proper use of seatbelts at all times. 9.3. Authorized Car Seats: Children are required by law to be secured in authorized car seats appropriate for their age and weight. The parent or guardian is responsible for bringing and properly installing the car seat. Child seats are available upon request from Select Transfers, but the Customer must inform Select Transfers of the child's age in advance to ensure proper seat availability.
10. Passenger Conduct 10.1. Prohibited Activities: Smoking, eating, consumption of alcohol or drugs, and any disruptive behavior are strictly prohibited within the vehicle. Violations of these rules will result in immediate termination of the ride without any right to compensation.
11. Force Majeure 11.1. Unforeseen Events: Select Transfers will make all reasonable efforts to fulfill its transfer obligations in a timely manner. However, Qivik SAS shall not be held liable for any delays or cancellations caused by unforeseen events beyond its reasonable control, such as: Adverse weather conditions (snow, ice, flooding, etc.), Traffic congestion, Riots, strikes, or other civil unrest, Accidents, Mechanical problems with the vehicle, Staffing issues
12. Snow Tire Chains 12.1. Mandatory Use: In extreme snow conditions, local authorities may mandate the use of snow tire chains for safe driving. In such circumstances, a surcharge of €90 will be applied to the transfer fee.
13. Subcontracting 13.1. Partner Network: To ensure service availability and meet customer demand, Select Transfers may occasionally subcontract transfers to partner drivers and companies. These partners are carefully selected to meet the same high standards of service and safety as Select Transfers. However, all subcontracted partners operate independently and are not employees of Qivik SAS.
14. Entire Agreement These Terms constitute the entire agreement between you and Qivik SAS regarding the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
15. Amendment Qivik SAS reserves the right to amend these Terms at any time by posting the amended Terms on the Select Transfers website. The amended Terms will be effective immediately upon posting. Your continued use of the Services following the posting of amended Terms constitutes your acceptance of the amended Terms.
